Terms of service

These terms govern your use of the TortieByte website (the “Site”). The Site is an informational webpage with a contact function. It does not sell goods, provide paid digital services, or take payments.

The Site is operated by TortieByte, an independent studio based in Germany. Full operator details are listed in the Imprint.

1. The Site is informational

The Site presents information about TortieByte and the products we build (CupBearer, Wordrio, Automotive Empire and any future products). It is not a transactional service. We do not sell goods or take payments on this Site. Where one of our products is available for download, the download is governed by its own terms on the relevant app store.

2. Contact form

You may use the contact form to send us a message. When you do, you confirm that:

  • the email address you provide is yours, or you are authorised to use it;
  • the message is your own and does not infringe anyone else's rights;
  • you will not use the form for spam, threats, harassment, or unlawful content.

We may ignore, delete, or report messages that violate these conditions. Submitting a message does not create a business relationship between us and does not oblige us to reply.

3. Intellectual property

All content on the Site — text, illustrations, logos, product imagery, the “TortieByte” name and mark, source code — is owned by TortieByte or its licensors and is protected by copyright, trademark, and other laws.

You may view the Site and quote short excerpts for personal, non-commercial use with attribution. Any other use, including reproduction, redistribution, mirroring, or commercial use, requires our prior written permission.

4. Third-party links

The Site may link to third-party sites such as app stores or providers' policies. We don't control those sites and aren't responsible for their content or practices. Following an external link is at your own risk.

5. Availability and changes

We try to keep the Site online and accurate but we don't guarantee uninterrupted access. We may change, suspend, or discontinue any part of the Site at any time, with or without notice. We may also update these terms; the “Last updated” date above shows when. Continued use after a change means you accept the new terms.

6. Disclaimers

The Site is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing on the Site is professional advice (legal, financial, medical, or otherwise).

7. Liability

To the extent permitted by law, TortieByte is liable only for damages caused intentionally or by gross negligence, and — within the limits of applicable consumer protection law — for damages caused by ordinary negligence to the extent they breach an essential contractual obligation. Our liability for ordinary negligence is in any case limited to typical, foreseeable damages.

This limitation does not apply to liability for injury to life, body, or health, nor to mandatory statutory liability (for example under the German Product Liability Act).

8. Privacy

Your use of the Site is also governed by our Privacy policy, which explains how we handle personal data.

9. Governing law and venue

These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected.

Where permitted by law, the courts at our place of business have exclusive jurisdiction over disputes arising out of or in connection with these terms.

10. Consumer dispute resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. The European Online Dispute Resolution platform was discontinued on 20 July 2025.

11. Severability

If any provision of these terms is or becomes invalid, the remaining provisions stay in effect. The invalid provision is to be replaced by a valid one that comes closest to its commercial purpose.
